An industrial design registration protects elements of shape, pattern and ornamentation applied to manufactured articles that appeal to the eye. Designs that are solely dictated by a function of the article, a method or principle of manufacture or construction, are not registrable. For design protection to be available, the design must be original in that no one must have previously applied that design to that article or similar type of article. As well, the design must not have been published in Canada or elsewhere more than one year before the filing date.
